AHCCCS Minimum Subcontract Provisions Regulatory Amendment

Arizona Health Care Cost Containment System (AHCCCS) updated its Minimum Subcontract Provisions (MPS). Subcontractors who provide services under the AHCCCS Programs including, but not limited to Acute Care, Children’s Rehabilitative Services (CRS), DCS/Comprehensive Medical and Dental Program (DCS/CMDP), and Regional Behavioral Health Authority (RBHA) must comply with the Provisions, applicable rules and statutes.

Effective October 1, 2016, the Minimum Subcontract Provisions under heading Acute Care, CRS, DCS/CMDP, and RBHA Contractors have been updated to reflect the below corrections in BOLD & UNDERLINED print:

  1. Commercial Liability: Commercial General Liability (CGL) – Occurrence Form
    • Policy shall contain a waiver of subrogation endorsement, as required by this written agreement, in favor of the State of Arizona, and its departments, agencies, boards, commissions, universities, officers, officials, agents, and employees for losses arising from work performed by or on behalf of the Subcontractor or Contractor.
  2. Business Automobile Liability: Combined Single Limit (CSL) $1,000,000
    • Policy shall be endorsed, as required by this written agreement, to include the State of Arizona, and its departments, agencies, boards, commissions, universities, officers, officials, agents, and employees as additional insureds with respect to liability arising out of the activities performed by the Subcontractor or on behalf of the Subcontractor or Contractor involving automobiles owned, leased, hired and/or non-owned by the Contractor Subcontractor.
    • Policy shall contain a waiver of subrogation endorsement, as required by this written agreement, in favor of the State of Arizona, its departments, agencies, boards, commissions, universities and its officers, officials, agents, and employees for losses arising from work performed by or on behalf of the Subcontractor or Contractor.
